The first step is to contact an experienced Real Estate Agent who knows the ins and outs of dealing with lenders regarding Short Sales.  This Agent will be the person who makes the many phone calls needed to the lender for this type of transaction.  In order for a lender to even consider a Short Sale, you must be what is referred to as upside down in your home.  You don’t have any equity in the home and the market value is less than the payoff of the loan.  Unfortunately in today’s market many people are finding themselves in this position and are either choosing a Short Sale or letting their home go to foreclosure.  For some the thought of foreclosure sounds like the best option because it can be up to a year before you must vacate the home and you are not making payments during that period.  But, if you wish to purchase a home in the future this would not be the way to go because of what it does to your credit rating.
